Abstract

From Cicero to Daniel Webster to Abe Lincoln to Bill O'Reilly, from sage philosophers to eloquent practitioners to the wisest of role models to the outraged demagogue, the criminal defense attorney who zealously defends even those who are likely to be guilty is steeped in controversy. In this Essay, the author postulates that the defense of the guilty is, as it has been for thousands of years, an integral part of keeping systems or criminal justice both honest and accurate and remains the primary bulwark against the conviction of the innocent.
