Abstract
This paper contains the report on a study for the European Commission, carried out by the author under a study contract, in 1997. The aims of the study were:
* to examine in detail the current (and, to a lesser extent, the proposed future) situation in the Member States of the EC with regard to the applicability of the Member States' national data protection laws to legal persons;
* to describe and evaluate the risks to the free movement of data within the Internal market resulting from the differences between the national laws in this respect; and
* to make recommendations as to the way in which the provisions of Directive 95/46/EC on the protection of individuals with regard to the processing of personal data and on the free movement of such data could be extended to the protection of the rights and interests of legal persons.
