Abstract

A critical review article of David Bilchitz's Poverty and Fundamental Human Rights, The Justification and Enforcement of Socio-economic Rights (Oxford: Oxford University Press, 2007), arguing that Bilchitz's conception of social rights is conceptually and normatively problematic, and that his criticism of the South African Constitutional Court is to a great extent unfair.

Keywords: social and economic rights, justiciability
