Abstract

MEMBER STATE POLICY (ECONOMIC PATRIOTISM) v. COMMUNITY COMPETITION POLICY Article 10 EC Treaty lays down the "Community Loyalty" principle. This principle allows Member States the right to maintain how to enact competition legislation that complies with the Community's principles. Article 86 EC Treaty (ex Article 90) states as follows:

Competition rules are not applicable to general services of a non-economic interest. Competition law provides sector investigations under Council Regulation 1/2003 on the rules on competition laid down in Article 81 and Article 82 EC Treaty. Member States could legislate that SME get more business thereby diversifying the market.
