Abstract

Two recent opinions of the Third Section of the Spanish Supreme Court have recently added a new twist to the rigor that has characterized its recent jurisprudence on corporate officer's compensation. The author claims that this time the Supreme Court might have gone too far. In his opinion - and this is the essence of the author's criticism - the new doctrine requires companies to meet certain challenges that are almost impossible to accomplish.
