Abstract

The author defends the view that a majoritarian democrat can, without inconsistency, condemn the legislature's decision to enact a statutory bill of rights. In doing so the author considers Jeremy Waldron's Kantian or strong-rights based attack on bills of rights and compares it to a consequentialist based attack.
