The Quest for Pan-European Licensing Solution: A Series of Unfortunate Events

Abstract

Since its 1995 Green Paper, the European Commission has been anxious to foster Europe-wide on-line licensing systems for the trans-border management of copyright and related rights. This process, however, was by no means uneventful. Indeed, through the monitoring of various undertakings falling under the scope of art. 81 TCE, tumultuous relationships with the European Parliament leading to the publication of a Sibylline 2005 recommendation for on-line licensing, and the recent condemnation of the CISAC agreements for the management of on-line music rights, the European Commission, using competition law, dramatically changed the panorama of on-line - and potentially off-line - music licensing.

Depuis son Livre Vert de 1995, la Commission Européenne a souhaité faciliter le développement de systèmes de licences transfrontières en matière de droits d'auteur et droits voisins. Ce processus ne s'est toutefois pas déroulé sans heurts. En effet, à travers le contrôle de multiples ententes potentielles, de tumultueuses relations avec le Parlement Européen ayant mené à la publication d'une recommandation controversée et la récente décision concernant les modèles de contrats fournis par la Cisac, la Commission Européenne, en ayant recours au droit de la concurrence, a dramatiquement changé le panorama de la gestion de la musique en-ligne - et potentiellement hors-ligne.
