Abstract

In this article, Professor Finkelman discusses the challenges that the framers faced in creating the Bill of Rights. On one hand, the Federalists feared power vesting itself primarily in the states while the Antifederalists were weary of a strong national government. Both sides had to come together and compromise on the Bill of Rights to protect individual rights from both state and federal government.
