Abstract

Issues which limit the opportunity for law reform in the area of sexual assault include the cultural context of society, police response, and attitudes within the courts, especially those of judges. Easteal suggests a number of ways of overcoming these problems, such as: mandatory education; a fairer legal process to ensure the victim's rights; changing the composition of the judiciary; quality control of the courts and increased accountability with on-going research and monitoring of the police and courts; and attitude change within society.
