Abstract

This paper discusses the possibility of using monetary damages as compensation for violation of WTO agreement breaches calculated by reference to the expenditures of exporters in the complainant state. This remedy will avoid difficulties relating to the calculation of injury and will compensate those who are most directly injured from unfair trade practice, namely the suppliers, rather than the respondent state government.
