Abstract

This article describes the procedures for changing the representative status of a union through the process of decertification. This may be initiated by employees or by employers, and the parties’ ongoing obligations are further described in this article. The author refers to Section 9 of the National Labor Relations Act and relevant National Labor Relations Board rules along with decisions in which courts have considered employer conduct during this decertification process.
