Abstract
This act provides for a general duty upon persons in possession of protected health information to preserve the confidentiality of that information. The act contains a number of important exceptions to the duty of nondisclosure where the benefits of disclosure outweigh the subject’s privacy interest. In some instances disclosure is mandatory; in others discretionary.
