Abstract

This article examines, from an analytic and critical perspective, the dispositions that the 2005 Penal Code Draft destines to crimes of sexual meaning, assuming, like starting point of the exposition, that such text preserves the general features of current regulations, according to the physionomy that it acquired after the legal reforms of 1999 and 2004. The author proposes as something positive that the crimes appear structured around the idea of sexual integrity and that the authors of this pre-legislative document opted for maintaining the denomination and the basic structure of the types of violation, rape and sex abuse, despite the objections they deserve from a criminal policy point of view and from the legislative technique. The work also speaks in favor of the suppression of the types of incest, sodomy and outrage to the good customs, but strongly criticizes the inclusion of some figures relating to prostitution and other based on the idea of corruption of minors
