Abstract

This article is a survey of developments in evidence rules over 2004-2005. Topics include: Procedural Concerns, Relevancy, Witnesses, Hearsay, and Experts. These topics are broken into specific areas to update the Procedural law of res ipsa Loquitur, judicial notice, presumptions, appeals of evidentiary rulings.

Relevancy covers character evidence and other crimes or Acts, Consciousness of Guilt , Spoliation, Missing Witness and Collateral Source Payments

Witnesses includes: Dead Man's Statute, Juror Competency, Opinions, Refreshing Recollection, Leading Questions.

Hearsay includes: Party Admissions, Speaking Agent, Excited Utterance, Present Sense Impression, and Business Records. Expert Opinion covers: Appropriateness, Basis For Expert Opinion, and Frye.
