Abstract

This 12-page 2007 article is titled “Obtaining Confessions: From Arrest to Court Commissioner.” It was published in The Trooper magazine. The article assumes that, in a given case, both Miranda v. Arizona and general Fifth Amendment voluntariness standards have been satisfied. The article then analyzes the federal and state constitutional and statutory requirements for “prompt presentment” before a judicial officer as a predicate to the admissibility of a statement that otherwise complies with Miranda and voluntariness.
