Progress Continues on Patent Reform and Pro IP

Abstract

The 2008 fall elections encourage much Congressional work to be done quickly, but also slam some legislative proposals to a politically-sensitive halt. So it is with several intellectual property proposals that have been working their way through the committee process and are now emerging for full review.

The proposals include patent reform legislation, an act to strengthen enforcement of and penalties for copyright infringement, and possibly, orphan works legislation involving limitations on damages when a “reasonable search” was performed.

All of the proposals are likely to see Congressional action in the coming months. However, it is unknown which, if any, will be enacted. While the current status of each proposal is fairly clear, election year politics – particular in this historic Presidential election year – will soon become the 800 lb. gorilla looming over this Congressional cycle.
