Abstract

The paper compares political rights of foreigners under EU law and the ECHR. It considers political communication rights (the freedom of expression, assembly and association) and the relevance of the special limitation clause of Art 16 ECHR. It then moves on to discuss the relationship of political rights and the protection of foreigners from expulsion under the ECHR and EU law, in particular with regard to the requirement of a non-discriminatory sanction under EU free movement law. Finally, the article discusses rationales for expanding electoral rights, in particular in an EU context.
