Abstract

There are basically two broad categories of subject matter excluded from patentable subject matter in the United Kingdom – the “as such” exclusions, and the exceptions under the European Patent Convention (the “EPC”). The “as such” exceptions were covered in an earlier work. This paper covers the EPC exceptions as set out in Article 53 of that convention (which were enacted into domestic law in sub-sections 1(3), 1(4), 4A and 76A of the UK’s Patents Act 1977).
