Abstract

The paper defines the scope of banking law in Europe, pointing out different fields of this area of law and its evolution from contract law into an independent field in its own right at the example of French, English, and German law. The interplay between contract law, regulatory rules and unified law is further specified by reference to the influence of EC law on consumer credit, credit transfers, secured transactions, banking secrecy, and the ombudsman procedure.
