Abstract

This paper discusses standing to bring class actions in the Ibero American Model Code. In civil law countries, the trend is to not give standing to class members, as is the rule in U.S. class actions, but to associations and public entities and agencies. This solution, however, may not be possible in the United States because of the “case or controversy” requirement in the U.S. Constitution. This is an extremely important topic in comparative law.

El artículo discute la “legitimación colectiva” (legitimación para proponer demandas colectivas) en el Código Modelo de Procesos Colectivos del Instituto Iberoamericano de Derecho Procesal. Discute el poder del Ministério Público Fiscal, de las associaciones o NGOs y otros entes legitimados para proponer una acción colectiva.
