Abstract

Dutch language case commentary on the European Court of Justice (ECJ) judgment in case Monsanto Italia, regarding an Italian safeguard ban on Genetically Modified Organisms (GMOs), based on the precautionary principe. Discusses the role of precaution in the current EU legal framework for agricultural biotechnology, and deliberate release into the environment and market placement of genetically modified organisms (GMOs), also in the context of the (former) Novel Foods Regulation.

"[...] In deze zaak stond het Hof voor meerdere balanceeroefeningen. Niet alleen moest het een brug slaan tussen de twee vaak tegenstrijdige doelstellingen van Verordening 258/97: onbelemmerde werking van de interne markt, en bescherming van de volksgezondheid. Tevens stond het Hof voor de taak de economische vrijheden van de verzoekende biotechnologie ondernemingen af te wegen tegen de bevoegdheid van lidstaten om op hun grondgebied de veiligheid voor mens en milieu te waarborgen. [...]"
