Abstract
This paper recounts the origin of the freedom of the press in Australia, and, in particular, the contribution made by the first Chief Justice of the Supreme Court of NSW, Sir Francis Forbes, in protecting the press from governmental interference in the earlier nineteenth century. It also discusses the early debates in the colony on the effect of the law of libel on the liberty of the press, and the role that an independent judiciary, supported by a vigorous and independent bar, has in the preservation of liberties.
