Abstract

Kenya is a country at a crossroad, struggling to manage a unique transition. Members of the former totalitarian regime still remain in control of the government after 18 years, since the start of pro-democracy campaigns for change. Minimum success has been achieved, including the current multi-party democracy from singe party rule, but redress for past injustices remain unattended. The past injustices can be regarded to be the root causes of current conflict that include, but are not limited to, corruption, impunity, insecurity and crime, the growing divide between the rich and the poor, abject poverty and general ethnic polarization.

Keywords: criminal prosecutions, impunity, past atrocities, injustice
