Abstract

Department of Labor administrative policy under ERISA Section 404(c) determines how employers and plan service providers provide retirement investment education and investment advice to participants in self-directed 401(k) plans. This article concludes that current Department of Labor policy is inadequate and proposes specific regulatory changes so that ERISA policy reflects the reality of participant financial illiteracy.
