Abstract

Robert Stevens's recently published book Torts and Rights offers an interesting interpretation of English tort law. Most discussions of this book focused on the extent to which this book accurately describes the law. In this review I focus instead on the book's theoretical foundations. I argue that though the book offers an original and interesting interpretation of English law, its arguments highlight the limitations of a rights-based interpretation of tort law.
