Abstract

בדיקות פרטיות לגילוי מומים בעובר, המבוצעות אף בהיעדר אינדיקציה רפואית לצורך בביצוען, נפוצות במדינת ישראל יותר מאשר בכל מדינה אחרת בעולם. המגוון הגדול של בדיקות המאפשרות אבחון טרום לידתי של מומים, הביא לפתחו של בית המשפט את שאלת היקף חובת הגילוי המוטלת על הגניקולוג. עניינה של רשימה זו הוא בחינה ביקורתית של הכלל המשפטי שאומץ על-ידי בית המשפט העליון בפסק-הדין בעניין סידי, לפיו על הרופא חלה חובה ליידע את האישה באשר לאפשרות לבצע בדיקת אבחון טרום לידתי באופן פרטי, אף בהיעדר אינדיקציה רפואית לצורך ביצוען. במאמר מוצגת הטענה כי אף שכלל זה עולה בקנה אחד עם דוקטרינת ההסכמה מדעת ועם עקרון אוטונומית החולה, הרי שאופן ניסוחו ואופן הצגתו בפסק-דין סידי הינו בעל השלכות ערכיות וחברתיות המעוררות קושי. במסגרת זו יעסוק המאמר בקשר שבין הכרעת בית המשפט בעניין סידי לתיאוריות אאוגניות ויעשה שימוש ברעיונות הלקוחים מהאסכולה של Disability studies .

Private tests to detect fetal anomalies, performed even in the absence of medical indication for their execution, are more common in Israel than in any other country in the world. The large variety of these tests, that allow prenatal diagnosis of fetal anomalies, has brought to the court the question of the extent of the duty of disclosure imposed on a pregnant woman physician. This article is a critical review of the legal rule adopted by the court ruling in the matter of Sidi, according to which the physician is obligated to inform the woman about the possibility to perform prenatal diagnostic test, privately, even in the absence of medical indication for their execution. I argue that although this rule is consistent with the doctrine of informed consent, and with the principle of autonomy which is its basis, the formulation and presentation of this decision has lead to negative ethical and social implications. First, I will present the law ruling in the matter of sidi, the rule that preceded it, and the judgments that followed it. Then, I will criticize this ruling.
