The Hypothetical Case in the Classroom

Abstract

This article suggests a novel teaching method in which the instructor creates a case out of whole cloth. A number of examples found in casebooks are discussed, and the author presents a case that can be used to introduce performance issues in the Contracts class. The hypothetical case can be particularly useful to present different theories in concurring and dissenting opinions so the student sees how the same topic can be looked at through a variety of lenses.
