Abstract

This paper presents an overview of the current state of transgender law in the United States, with a historical, international and humanitarian flavor. Initially, the reader is educated on transgender terms. Current and existing federal laws that lend protection to transgender persons are then discussed as well as amendments to the U.S. Constitution. The Yogyakarta Principles are briefly mentioned. Lastly, the writer identifies what he believes to be the major issues confronting transgender persons, setting out case law from various jurisdictions (the later being detailed and emphasized in footnotes). The introduction and conclusion present the writer's point of view going forward.
