Abstract

While various provisions of the FCLAA reflect the goals of an energy/natural resources policy that flourished in the mid 1970s, how those policies became translated into particular statutoy -- and ultimately regulatory -- provisions may or may not make sense over twenty years later. This article reviews the continued efficacy of aspects of the program, and in particular the due diligence requirements.
