Abstract

Of the various arguments made for the elimination of life tenure for Supreme Court Justices, some are non-ideological in character; others are "zero-sum" and depend on politics. This article discusses arguments of the the second type. It considers which arguments on the subject are rightly considered political, and whether they are well-founded on their terms. The article is a sequel to an earlier one, The Regulation of Turnover on the Supreme Court.
