Abstract
The European Union has undertaken a long and broad process of harmonization of private international law. This process amounts to a level of cross-border previously unknown. Despite this situation the European Union lacks common rules on application of foreign law by national courts. This entails to several important problems impairing the smooth functioning of the whole system. This article studies in depth the existing situation in Europe as to this issues, analyzing all problems created and proposing solutions to this situation.
