Abstract
In response to concerns about high search ranking accorded infringing content, Google recently altered its iconic search algorithm to integrate takedown notice data from copyright owners. The major content industries applauded this move, while some scholars and cyberlibertarians expressed alarm. This commentary contends that this shift reflects the natural and appropriate path for technological progress to integrate broader social concerns into innovation. It cautions, however, that in order for this initiative to succeed in advancing technology, promoting expressive creativity, and not hampering free expression, Google must be transparent in its implementation and continue to evolve its search algorithm in response to abuses of the takedown process.
