Abstract
Concept adoptat de dreptul internaţional public jus cogens desemnează norma strict obligatorie caracterizată prin inderogabilitate şi care în condiţiile încălcării sale atrage nulitatea de plin drept a tratatelor sau convenţiilor ce conţin reglementări derogatorii de la aceste norme. Conceptul a cunoscut o evoluţie ascendentă încă din dreptul roman fiind în acelaşi timp şi o instituţie de drept intern care abia după adoptarea Convenţiei de la Viena din 1969 asupra Dreptului Tratatelor adevenit una dintre cele mai importante dar şi comentate instituţii de drept internaţional public.
Concept adopted by the international public law, jus cogens designates the strictly compulsory law characterized by compulsoriness and under the conditions of breach, it draws the rightful nullity of treaties or conventions that comprise derogatory regulations from these laws. The concept has known an ascending evolution ever since the Roman law being at the same time an institution of domestic law that after the adoption of the Wien Convention from 1969 on the Treaties Law has become one of the most important and commented institutions of public international law.
