Abstract

Section 92 was the most litigated section of of the Australian Constitution. This article reviews that litigation from when it began in 1909 through until the key, 'turning point' case of Cole v. Whitfield (1988). Over this period, the High Court of Australia and the Judicial Committee of the Privy Council considered Section 92 in over 140 cases. Cole v. Whitfield ushered in a long argued for, notably more cogent reading of Section 92.
