Abstract

Guinea’s new government began the process of reform in its mineral sector by passing, in September, 2011, a new mining code. But much remains to be done to create policy and practice out of the statutory framework, and many issues remain unresolved between the government and the multinational companies that mine in Guinea. This paper considers key issues for the mining concession review process the new administration has announced and for future concession negotiations. It does so with an eye towards provisions of a model contract and future statutory reform. Key issues covered include revenue generation, stabilization, and transparent revenue management. In its recommendations, the paper draws on West African regional experience, particularly that of Liberia, which has drawn recognition and praise for its efforts to manage responsibly the natural resources that fueled its 14-year conflict.
