Abstract

Nanotechnology is an exciting and highly celebrated emerging technology dealing with extremely small particles with very special features. Nanoparticles are used in products ranging from self-cleaning glasses, spill-free jeans, and anti-bacterial coatings to enhanced animal food. The applications for nanotechnology in every day consumer and health goods are almost infinite.

However, with the increased use of nanotechnology, concerns have been raised as to the effect of nanotechnology on health. Little is currently known about the possible risks of nanotechnology on human and animal health and the environment, other than that nanotechnology has the ability to affect living cells and even the DNA structures of living systems. This may pose significant risks, which suggests that regulation of these materials should make reasonable use of the precautionary principle, rather than avoiding any and all interference in the market.

This paper compares the nanotechnology-related legislation of different jurisdictions worldwide; assesses Hong Kong’s legislation on nanotechnology; and recommends changes and improvements to this legislation.
