Abstract

The UK Commission on a Bill of Rights asks in its second consultation paper whether any Bill of Rights should contain a right to administrative justice. This paper argues that including such a right may serve little practical purpose and may unnecessarily complicate the law. The paper further argues that the consultation undertaken by the Commission is problematic in that it is difficult meaningfully to comment on the desirability of including particular rights within a Bill of Rights in the absence of any preliminary view on the Commission's part about the likely status of a Bill of Rights and any rights contained within it.
