Abstract

"שימוש במקרקעין" - יישומו המוטעה של מבחן הסעד והשלכותיו בשנות השישים נקבעו כמה הלכות יסודיות בסוגיית הסמכות העניינית, הידועות במקומנו כהלכת שמש, הלכת גולדמן, והלכת כיכר הרצל. הלכות אלה קבעו חריג לסמכותו העניינית של בית משפט השלום, הקבועה בס' 51(א)(3) לחוק בתי המשפט, והגבילוה לתביעות שעניינן שימוש במקרקעין תוך שמירה על גוף הנכס. דבר זה הציף את בית המשפט המחוזי בתביעות קלות ערך. לימים, ובד בבד עם הרחבת סמכויותיו של השלום, הלכה וגברה הקריאה לביטול חריג מלאכותי זה, ולהכללתן של כל תביעות השימוש במקרקעין, אף אלו שאינן תוך שמירה על גוף הנכס, בסמכות השלום. עיון מדוקדק בהלכות אלו מגלה במפתיע, כי טמונה בהן בעיה בסיסית יותר; הלכות אלו הפעילו בצורה שגויה את המבחן הקובע בענייני סמכות – מבחן הסעד. חידוד קווי המתאר של ההליך השיפוטי מלמד כי הלכות אלו סטו בהיסח הדעת ממבחן הסעד, ואימצו למעשה את מבחן העילה, המתמקד במעשיו של הנתבע. כתוצאה מכך, מזה כיובל שנים סובלת מערכת המשפט מסתירות ובלבול בשאלת זהות הערכאה המוסמכת לדון. במהלך השנים יצר בית המשפט העליון אבחנות שונות כדי לסייג הלכות בעייתיות אלו, דא עקא – אבחנותיו אלו רק הוסיפו סרבול על סרבול והן בבחינת תיקון עוול אחד בעוול אחר. זווית הראייה החדשה שמציעה רשימה זו עשויה לשפוך אור בהיר על שאלה פרוצדורלית זו, ואף לחלצה מן הסבך שאליו נקלעה.

This article discusses the civil procedure and the issue of subject matter jurisdiction of the Magistrate Court and District Court. In the sixties fundamental legal rules established exception to the jurisdiction of the Magistrate Court. These legal rules limited the subject matter jurisdiction prescribed in section 51 (a) (3) of the Courts Act to cases involving any use of real estate in which property is not damaged. This determination loaded the District Court with minor claims whenever the use of real estate resulted in damage regardless of its scope. Before these rulings, such cases would be heard by the Magistrate Courts. This paper argues that these legal determinations incorrectly operated the principle that determines the subject matter jurisdiction. This principle provides that the subject matter jurisdiction of the claim is determined by the rellief sought by the plaintiff rather than the subject of the claim. These legal rules inadvertently strayed from the relief principle and adopted the subject priniciple, which focuses on the actions of the defendant and not on the plaintiff's relief. The new perspective offered in this article can shed some light on this procedural question, and recover it from its entanglement.
