Abstract

Le « droit d’intervention » énoncé à l’article 4h) de l’acte constitutif de l’Union africaine a été interprété largement par une partie de la doctrine, qui y a vu un signe de l’émancipation possible d’une organisation régionale vis-à-vis de l’ONU. La présente contribution remet en cause ce point de vue à partir de la pratique récente. Dans un premier temps, on analyse les débats qui ont eu lieu à ce sujet au sein de l’ONU ces dernières années. On constate ainsi que le schéma d’un droit d’intervention centralisé, mené sous l’égide du Conseil de sécurité, est loin d’avoir été remis en cause au profit d’une tendance « régionaliste » à l’émancipation. Dans un deuxième temps, on se penche sur le précédent de la Libye, qui confirme de manière particulièrement éclatante la faible autonomie de l’Union africaine sur le plan du recours à la force.

The "right to intervene" enshrined in Article 4 h) of the Constitutive Act of the African Union has been widely interpreted by some writers, who consider it as a sign of possible emancipation of a regional organization vis-à-vis the United Nations. This paper challenges this view on the basis of recent practice. In a first section, the discussions that took place on this subject within the United Nations in recent years are exposed. Those discussions reveal that the centralization of the right of military intervention under the authority of the Security Council has not been challenged in favor of a "regionalist" emancipation The second section is dedicated to the precedent of Libya, which obviously confirms the limited autonomy of the African Union as far as use of force is concerned.
