Patent Reform in the United States: Lessons Learned
Date Written: January 2, 2013
Abstract
In 2011, after seven years of controversy and debate, the United States enacted the America Invents Act, the first major patent reform legislation in nearly 60 years. Not surprisingly, the legislation is a mixed-bag, effectively addressing some long-standing problems while leaving other problems to fester or to be resolved by the courts. It also creates new problems. This paper offers a critical assessment of the legislation.
