Abstract
In deze noot volgend op een vonnis van de rechtbank van Luik van 21 december 2005, pleit de auteur om de aanknopingsfactor in verband met het personeel statuut van (ex-)echtgenoten niet meer bij hun al dan niet gemeenschappelijke nationaliteit te leggen, maar wel bij het land waar zij de meeste band mee hebben, zijnde meestal hun gewoonlijke verblijfplaats.
In this article, following a judgement of the court of Liege from the 21th of december 2005, the autor pleads to make the applicable law concerning the personal statute of (ex)spouses not the one of their (common or different) nationality, but the one of the country where they have the most affinity: their usual residence.
