Abstract

Brazil and USA's Direct Foreign Investment - This report of inquiry comprises an analysis of the consolidation trajectory of the Legal and Economic Institute investment fund for foreign capital/nonresident investors in Brazil and USA. This is an important issue in the 21st century because of the current constitutional situation, and the increase of international pressures which caused a fast normative reconfiguration based on the varied demands imposed by the international community during the last ten years or more. At the end section it is analyzed the functionality of foreign capital investment funds from non-resident investors, as privided for in the Constitution as a foundation of the Republic, the social value of the free initiative (art. 1º, IV, CRFB).
