Abstract

We encounter various examinations daily – medical, mental and physical. We are exposed to examinations before we are born and after we die. In this paper I focus on the involvement of examination practices in the family system. I claim that these practices are used to control and ensure the preservation, existence or dissolution (which I will term "alignment") of the traditional family cell. My claim is examined in three time points: past, present and future, Examination of "alignment" in the past focuses on how the examination practices came to be perceived as accepted medical procedure, allegedly devoid of elements of social control or other social goals. Examination of "alignment" in the present focuses on the various ways, expressed in legislation, in rulings and in custom, to gain control or dissolution of the traditional family cell. Examination of "alignment" in the future (becoming expressed to a certain extent in legislation and ruling in the present) will focus on whether the examinations can help the ruling system in achieving its goals, including creating a better future generation even despite (or perhaps thanks to) the absence of a traditional family cell. That is, I will ask whether when the state allows deviation from the traditional conventional family cell, it can enhance its monitoring individuals in the population through the system of forced examinations. The question underlying these issues concerns the relation between forcing examinations or excluding from them and oppression and discrimination against women. In this sense, the paper will examine the bioethical issue from a legal-feminist perspective.
