Abstract

This is an annotated version of an oral argument in support of a motion to dismiss on the basis of torture that I gave in a pretrial motion hearing in a military commission at Guantanamo Bay, Cuba, on August 14, 2008 in the case of U.S. v. Mohammed Jawad. This was the second oral argument on the motion. I published an annotated version of the first argument in the Harvard Human Rights Journal (Citation: David J. R. Frakt, Closing Argument at Guantanamo: The Torture of Mohammed Jawad, 22 Harvard Human Rts J. 1 (2009).) This, is, in essence, a sequel of that argument and article. In the argument I discuss new evidence regarding the use of the frequent flyer sleep deprivation program on Mohammed Jawad and other detainees, abuses perpetrated by BSCT psychologists, and abuses which occurred at Bagram Prison.
