The Newly Released ‘Common Approach’ on EU Agencies: Going Forward or Standing Still?

Abstract
Following the European Commission’s Communication “European agencies – The way forward” the EU’s three main institutions, i.e., the Council, the European Parliament and the Commission, have launched an interinstitutional working group on agencies whose three year negotiations have resulted in the “Common Approach” on EU agencies. While the official press release offers a long list of “a range of improvements,” “the work on … decentralised agencies has not come to an end,” said Jutta Haug, the German MEP (S&D) representing the European Parliament in the talks. This article offers a critical analysis of the “Common Approach” and shows that while progress has been made on a number of issues, it is still eclipsed by several serious factors, especially the non-binding character of the newly released document.
