Abstract

Portuguese Abstract: O texto apresenta uma análise comparada entre os sistemas brasileiro e europeu, quanto ao reconhecimento e execução de decisão judicial estrangeira, notadamente quanto aos efeitos automáticos das decisões estrangeiras e a competência processual dos tribunais para exercer o juízo de delibação (compatibilidade da decisão estrangeira com a ordem pública do Estado requerido).

English Abstract: This text presents a comparative analysis between the Brazilian and European systems, with respect to the recognition and enforcement of foreign judgments, especially, the automatic effects of foreign judgments and procedural jurisdiction of the courts to make sure the foreign judgment is not contrary to the public policy of the State in which recognition is sought.
