Abstract

Any rule of law has certain defining features, as it is absolutely necessary for it to fulfill certain requirements. Some of these requirements are important for the validity of that norm (for example the requirement that it does not violate a superior rule of law), while others are important for the efficiency of that rule (for example the requirement that it must be expressed in a clear, non ambiguous language). The failure to comply with the latest does not necessarily brings the invalidation of that norm, but a rule of law that does not reach its purpose is, in any case, a failure. A definition, no matter how complex or accurate, could not explain the rule of law as well as defining the main characteristics that a rule of law must have, simultaneously, in a state governed by the rule of law.
