Abstract

The 2006-2007 term coincided with the 25th anniversary of the Canadian Charter of Rights and Freedoms. The Court was active, issuing numerous important decisions in constitutional law. This article reviews fourteen significant cases. Decisions reviewed include Charkaoui (challenge to security certificate regime under the IRPA); Health Services and Support (scope of the Charter’s fundamental freedom of association); Christie (rule of law challenge to provincial tax on legal services); Canadian Western Bank (proper scope of interjurisdictional immunity); Hape (application of Charter to Canadian officials engaged in investigations on foreign soil); Kingstreet Investments (remedies for ultra vires taxes); and Hislop (availability of retroactive remedies for Charter violations).
