Abstract

Noot bij beslissing van Hof Arnhem van 18 Sept. 2012 A v B & Stichting Slachtoffers Iatrogene Nalatigheid.

Analyse van belangenafweging voor toekenning ordemaatregelen in kort geding, hier bestaand uit (o.a.) een verzoek om een ex-patient een domeinnaamregistratieverbod op te leggen voor het verbieden van enige domeinnamen die de naam van de arts mede bevaten. Het verzoek wordt toegewezen op grond van onrechtmatige daad. Redengevend daarbij is met name dat die domeinnamen vooral gebruikt zouden worden om de reputatie van de arts aan te tasten. Het beroep op vrijheid van meningsuiting van de ex-patient wordt dus afgewezen. De noot gaat ook in op andere toepasselijke juridische gronden zoals misbruik van bevoegdheid (ar. 3:13 BW) en de bescherming van persoonsnamen (art. 1:8 BW).

Case-comment in leading (peer-reviewed) law review in the Netherlands on the decision of the Court of Appeal Arnhem of 18 Sept. 2012 between A v B & Stichting Slachtoffers Iatrogene Nalatigheid.

Analysis on judicial balancing of granting temporary restraining orders in summary proceedings, here consisting of a request to prohibit an ex-patient to register any domains incorporating the name of a medical doctor. Request was granted on the basis of tort. The Court of Appeal held that such domains were apparently only used for defamatory statements damaging the reputation of the medical doctor. The freedom of speech defense by the ex-patient was therefore denied. The case-comment also addresses other applicable legal grounds such as 'abuse of power' (art. 3:13 Dutch Civil Code) and protection of personal names (art. 1:8 Dutch Civil Code).
