Bringing the Courts to Heel: Substituting Legislative Policy for Judicial Discretion

18 Pages Posted: 30 May 2000

Abstract

Rather than examining the big picture of how state legislatures flex their muscles, this essay discusses a microcosm on that subject. It is a collection of war stories about a relatively narrow topic from a single state-Texas. These tales of joint custody and visitation illustrate the author's broader point that, as the twentieth century winds down, legislatures increasingly choose to regulate family law in very fine detail.
